Regardless of the new location, a parent who shares custody, parental responsibilities, or parenting time cannot relocate a child without advising the court. However, it is important to understand what constitutes a relocation. For parents currently living in DuPage County, Kane County, Will County, or the other collar counties in the greater Chicago area, moving more than 25 miles away from their current home is considered to be a relocation. When a planned move meets these criteria, a parent will need to follow certain procedures in order to receive approval for a relocation and make any necessary adjustments to child custody.

In a child relocation case, a modification must be made to the original child custody/parental responsibilities agreement.
